The High Court hears case on the lockdown tobacco sales ban

The Free Trade Independent Tobacco Association (Fita) will on Wednesday tell the full bench of the high court in Pretoria why it believes regulations prohibiting the sale of cigarettes and tobacco products should be set aside.
On the other side of the court, lawyers for cooperative governance and traditional affairs (Cogta) minister Nkosazana Dlamini-Zuma will present arguments as to why the ban should remain in place.
It has been just over a month since the association filed papers to challenge the decision to ban the sale of tobacco products during the lockdown.
This is how the saga has played out.

March 26: South Africa's complete lockdown begins - at level 5. Among the prohibitions are that alcohol and tobacco products can not be sold.
April 23: In a televised address to the nation, President Cyril Ramaphosa announces that the sale of cigarettes, which had been prohibited under the initial hard lockdown, would be allowed when the country moves to level 4 from May 1.
April 29: Regulation 27 is promulgated in the government gazette by Dlamini-Zuma, and it expressly bans the sale of tobacco products and cigarettes.
May 4: Fita files an application in the high court to set aside the ban. The application by Fita is in two parts. In Part A, Fita seeks an order declaring that tobacco and cigarettes fall into the category of agro-processing products and their export is permitted. In Part B, Fita wants the court to set aside regulation 27. It is this second part being argued in court on Wednesday.
May 6: Dlamini-Zuma files a notice to court to indicate that the government will oppose Fita's application.

May 7: The state attorney, in a letter to Fita's lawyers, states that the manufacturing and export of tobacco products is permitted under level 4, rendering Fita's application regarding Part A moot.
May 26: Dlamini-Zuma provides the court with the reasons that were taken into consideration when formulating regulation 27.
May 29: Fita files an amended application, which wants to the court to review and set aside regulation 45, which continued the prohibition on the sale of tobacco products under level 3, which starts on June 1.
June 2: The state attorney writes a letter to the office of the judge president requesting that the case, set to be heard on June 9 and 10, be rescheduled for the week beginning on June 22. One of the reasons is that Dlamini-Zuma needs to address the challenge to regulation 45.
June 2: Lawyers representing Fita reply that the request for the application for a postponement must be denied.

June 3: Dlamini-Zuma files an answering affidavit, which concludes that Fita has not made out a case for the relief it seeks in Part B of the application.
June 6: Fita files a replying affidavit, which concludes that it persists with the relief it seeks.
June 8: Legal submissions from both parties are submitted to court.
June 9: The full bench of the high court, headed by judge president Dunstan Mlambo, sets aside this day to read through legal arguments.
June 10: Oral arguments are to be heard in the case

Orlando Pirates win race to sign Bafana captain Thulani Hlatshwayo from Bidvest Wits

Orlando Pirates have won the race to sign Bafana Bafana captain Thulani Hlatshwayo from Bidvest Wits‚ TimesLIVE has established.
Sources close to the player say Hlatshwayo will pick playing for Pirates rather than Mamelodi Sundowns‚ who had expressed interest in him after it emerged the Wits owners were selling the club.
“Pirates have got him. He has told Sundowns he will join Pirates‚” a source told TimesLIVE.
Majority owners of Wits‚ Bidvest‚ have put the club up for sale and a deal with Limpopo businessman Masala Mulaudzi is already in place.
The impending sale has brought about panic in the club‚ with several players now looking to secure a move and many‚ it is understood‚ reluctant to relocate to Limpopo‚ where the new owners will move the team

Hlatshwayo‚ 30‚ is arguably Wits’ most prized asset at the moment and it was no surprise that both the Buccaneers and Sundowns were eager to have him.
While Sundowns did the initial approach‚ Pirates are now understood to have won Hlatshwayo’s heart.
His agent Mike Ntombela would not confirm or deny that the central defender is headed to Bucs.
“The fact of the matter is that he belongs to Wits. He renewed his contract and has two years to run still‚” Ntombela said.
“For anything to happen‚ Wits must give the go-ahead.”
But he did confirm there had been interest from both Pirates and Sundowns‚ adding only Hlatshwayo will make a decision on where he wants to play.

He decides for himself‚ I can only advise here and there‚ but ultimately‚ he decides. He can play at any team‚ including Sundowns and Pirates.”
Hlatshwayo has been on Pirates’ radar for over two years‚ with Wits turning down an offer last year.
The Clever Boys’ hand has now been forced by their impending sale‚ with several other players set to leave the club.
Sundowns had bid for Hlatshwayo‚ Haashim Domingo and Deon Hotto‚ but a source said they will only succeed with Domingo at this stage‚ with Hotto also undecided between going to the Brazilians or Bucs.

Bushiri to congregants: 'Major 1 is staying, it is done

Enlightened Christian Gathering church leader Shepherd Bushiri told thousands of congregants gathered at a service on Sunday February 10 that he is here to stay.
Bushiri and his wife, Mary, spent five days in police custody after being arrested on charges of fraud and money laundering.
They were released on R100,000 bail each.
Bushiri returned to the pulpit to preach over the weekend, promising his congregants that he was "here to stay."
"I'm coming with a testimony. My story is changing. In the name of Jesus Christ. Today is a wonderful day when your past, your present and your future will be together. If you feel like a trip, your problem is over," he said.
As you leave this place, you must leave with this information. Major 1 is staying. It is done. It doesn't matter what people are saying about you. Major 1 has said it is done," he added.

The Pretoria Show Grounds had an overflow of people as thousands flocked to hear their "daddy" - the name they call Bushiri  - preach.

The pastor has denied the claims against him, with his followers insisting that there is a vendetta against him.
